The following scorecard lists several key votes in the North Dakota Legislature in 2021 and 2022 and ranks state representatives and senators based on their fidelity to (U.S.) constitutional and limited-government principles.
This is our first state-level Scorecard; the selected votes may not be reflective of legislators’ overall records. Their cumulative scores will change as we add more votes. Please check regularly for updates.
Senate
1. Rescind Article V Con-Con
SCR4004 Rescind Article V Con-Con (Rejected 15 to 32 on 2/9/2021). Rescinds all existing applications the North Dakota legislature to call a convention to propose amendments to the United States Constitution. See U.S. Const., amend. VI.
2. Mask Mandates
HB1323 Mask Mandates (Passed 32 to 15 on 4/22/2021). Prevents any government within the state, including schools, from being able to mandate the wearing of masks.
3. Gun Rights-Enforcement
HB1383 Gun Rights-Enforcement (Passed 40 to 7 on 4/19/2021). Prohibits a law enforcement officer or individual employed by the government within the state to provide assistance with an investigation, prosecution, or enforcement of an unconstitutional federal law.
4. Nullification
HB1282 Nullification (Passed 32 to 15 on 3/31/2021). Creates a committee with the purpose of acting on federal nullification of any unconstitutional law.
5. Compact for Balanced Budget
HB1429 Compact for Balanced Budget (Passed 37 to 10 on 3/22/2021). Extends North Dakota's current membership in the Compact for a Balanced Budget through 2031.
